1. Acceptance of Terms

By accessing or using OpenHealthData ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, please discontinue use of the Platform immediately.

These terms apply to all users including healthcare vendors, consultants, providers, government agencies, researchers, and members of the public.

2. Nature of the Data

All data presented on OpenHealthData is sourced from publicly available datasets published by the Centers for Medicare & Medicaid Services (CMS), a federal agency of the United States Department of Health and Human Services.

OpenHealthData does not create, modify, or editorially alter the underlying quality scores, ratings, or outcome measures. We transform and present CMS data to make it more accessible. Data accuracy is subject to CMS reporting cycles, which are updated quarterly.

OpenHealthData is not affiliated with, endorsed by, or sponsored by CMS or any government agency.

3. Not Medical Advice

Nothing on this Platform constitutes medical advice, diagnosis, or treatment recommendations. Quality scores and performance metrics reflect administrative and outcomes data reported to CMS and should not be used as the sole basis for selecting a healthcare provider.

You should always consult a licensed physician, specialist, or other qualified healthcare provider before making any medical decisions. OpenHealthData expressly disclaims any liability arising from reliance on information presented on the Platform for medical purposes.

4. No Provider Endorsement

References to providers as "highest scoring," "top rated," or similar language reflect CMS-reported performance metrics only. OpenHealthData does not independently verify, certify, endorse, or recommend any healthcare provider, facility, or organization listed on the Platform.

A high score does not guarantee quality of care for any individual patient. A low score does not mean a provider is unsafe or unsuitable. Data reflects population-level outcomes and should be interpreted in context.

5. Data Currency and Accuracy

CMS data is released on a quarterly basis. There may be a lag between real-world changes at a facility and the data reflected on this Platform. OpenHealthData makes reasonable efforts to update data following each CMS release but does not guarantee that all information is current at any given time.

Users relying on this data for business, research, or operational decisions should verify currency directly with CMS sources at data.cms.gov.

6. Permitted Use

You may use the Platform for lawful purposes including:

  • Research and analysis of healthcare quality metrics
  • Sales prospecting and market analysis by healthcare vendors
  • Performance benchmarking by healthcare providers
  • Policy analysis by government agencies and researchers
  • General informational use by members of the public

You may not scrape, systematically download, or reproduce Platform content for commercial redistribution without written permission from OpenHealthData.

8. Intellectual Property

The underlying CMS data is in the public domain. The OpenHealthData platform design, user interface, visualizations, and proprietary analysis are owned by OpenHealthData and may not be reproduced without permission.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the Platform following any changes constitutes acceptance of the updated terms. The date of the most recent revision is indicated at the top of this page.
